Background

1.1 Origins of the Report

On 31 May 1990, the Treasury Board approved a requirement for a report on the contracting activity of departments and agencies. The purpose of this reporting requirement is to enable the Secretariat (i) to evaluate whether departments and agencies are complying with contracting policies, especially the requirement for competitive contracting, and (ii) to advise the Treasury Board of the total contracting activity throughout the Government.

1.2 The First Analysis: Coverage

In Fiscal Year 1991-92, fifty-three departments and agencies, which constituted the major contracting authorities in the Government, were requested to provide data on the contracts which they awarded. The information to be provided was to include estimates of the total number and total value of contracts, and whether the contract was competitive or non-competitive.

Most contracts which were awarded by departments and agencies were subject to the Government Contracts Regulations (GCRs) and the related Contracting Policy. However, certain contracts were subject to the obligations of international trade agreements, specifically either:

  1. the General Agreement on Tariffs and Trade (GATT)
  2. This only applied to contracts for certain goods whose value was in excess of SDR 130,000 (CAN $223,000); or

  3. the Canada-United States Free Trade Agreement (FTA)

This only applied to contracts for certain goods whose value was in excess of US $25,000 (CAN $29,000), but below the aforementioned GATT threshold.

All three of the preceding mandatory guides to contracting emphasized the use of competitive solicitation in connection with government procurement, although each recognized legitimate circumstances, the "exceptions", where this requirement was waived.

The GCRs, for example, allow for non-competitive solicitation in the following circumstances:

  1. a pressing emergency in which delay would be injurious to the public interest;
  2. the estimated expenditure does not exceed:
  3.  
    • $30,000; or
    • $100,000, where the contract is for the acquisition of architectural, engineering and other services related to the planning, design, preparation or supervision of the construction, repair, renovation or restoration of a work or an international development program or project;
  4. the nature of the work is such that it would not be in the public interest to solicit bids; or
  5. only one person is capable of performing the work.

1.3 The First Analysis: General Observations

The analysis of the contracting activity of 53 departments and agencies for Fiscal Year 1991-92 noted:

  • from Table: there were (approximately) 191,000 contracts awarded valued at $9.1 billion.

All departments and agencies were sent a summary table to enable them to compare their results with those throughout the Government and to encourage them to increase their competitive solicitation (particularly those with the lowest percentages of competitive service contracts).

The current analysis: fiscal years 1992-93 and 1993-94

2.1 Coverage

In Fiscal Year 1992-93, fifty-one departments and agencies submitted reports on the contracts which they had awarded. The 1991 Budget wound up a number of organizations which had previously reported, including the Economic Council of Canada and the Office of Privatization and Regulatory Affairs.

In Fiscal Year 1993-94, contracting reports were received from forty-nine departments and agencies. This reflected the creation of Public Works and Government Services Canada from the amalgamation of the departments of Public Works and Supply and Services, and the unification of the components of Revenue Canada (Customs and Excise, and Taxation).

In January 1994, there was, as well, a change in the procurement obligations arising from international trade agreements. The North American Free Trade Agreement (NAFTA) replaced the Free Trade Agreement, and there was a significant increase in the extent of government procurement which became subject to such agreements.

NAFTA applies to contracts for a wide variety of goods, services and construction. The NAFTA thresholds are:

2.2 General Observations

A. Fiscal Year 1992-93 (51 departments and agencies reported)

from Table: there were (approximately) 171,000 contracts awarded valued at $9.8 billion.

B. Fiscal Year 1993-94 (49 departments and agencies reported)

from Table: there were (approximately) 183,000 contracts awarded valued at $8.9 billion.

Future influences

3.1 New Trade Agreements

There are a number of new trade agreements which will be coming into effect shortly which will have an effect on government procurement. These agreements emphasize competitive solicitation, non-discrimination among suppliers, and will cover a wide variety of goods, services and construction.

  1. the Agreement on Internal Trade (AIT)
  2. Effective 1 July 1995, it applies to the procurement activities of the Governments of Canada, the Provinces, and the Territories.
